Recognizing And Combatting Gender Discrimination In The Workplace
Many people consider gender discrimination in employment to be a relic of the past. It is not. The fight continues to this day and has expanded, thanks to a greater understanding that gender is not as limited or fixed as it has traditionally been regarded.
At Maloney O'Laughlin PLLC, our attorneys fight for the rights of employees across Washington, including those who have suffered sex or gender discrimination.
Protections Under Federal And State Laws
Title VII of the Civil Rights Act of 1964 prohibits employment discrimination on the basis of sex or gender. While the act does not explicitly offer protections based on sexual orientation or gender identity, important court rulings in recent years have extended protections to members of the LGBTQIA community. The Washington Law Against Discrimination also prohibits sex/gender discrimination and does specify a ban on sexual orientation and gender identity discrimination.
Examples Of Sex And Gender Discrimination
Because most employers will not outwardly admit discriminatory behavior, it is often easier to prove sex/gender discrimination through larger hiring, promotion and pay trends at a given company. Examples could include:
- Unequal pay by gender for the same work
- Very unbalanced rates of promotion between men and women
- Sexual harassment
- Refusal to hire men, women, transgender or nonbinary individuals
- Different working conditions based on gender
- Different advancement opportunities, bonuses or others based on gender
